祖墳土地屬誰家 法官風水斷真相

林姓男子控告呂姓男子竊佔他家族土地建祖墳放骨灰,要求還地;呂拿出半世紀前向林父購地契約為證。法官認為,國人重風水,沒人敢犯大不敬竊佔土地建祖墳,也沒人會願意讓他人占地建墳多年而默不吭聲,認定呂購地為真,判林敗訴。林姓男子向新北地院主張,呂姓男子未經他同意,竊佔他家族位於新北市中和區鹿寮坑山區一塊約七十坪土地,搭建地上物欲存放祖先骨灰,還舖設水泥步道。

林說,呂雖提出土地買賣契約及證人,但契約書立約人及見證人的簽名是同一筆跡,契約書有問題,且他從未聽父親及哥哥生前提過賣土地給呂的事。呂姓男子說,一九六四年間,他聽風水師說林家這塊土地風水佳,他向林父買地,雙方請代書代立買賣契約書,並由林的哥哥當見證人,契約言明建祖先墳墓;當年他買地後即建祖父母的墳墓,有墓碑為證。

呂說,因墳墓年代久遠要重新整理,因此將祖父母骨骸暫時遷出,在原地整修成新式的祭祀宗祠供呂氏後人供奉,未料林竟誣指他無權占用。法官指出,林父及見證人都已死亡,僅能依經驗法則判斷。呂提出的契約書已陳舊泛黃,紙張邊緣多處有裂縫破損,是年代久遠之物,應非臨訟偽造。

法官認為,國人傳統觀念重土安遷,落地為安,深信墓地風水影響後代子孫吉凶禍福,有心替祖先尋找風水寶地者,應會購買長久安穩的土地建祖墳、放骨灰,以求庇蔭世代子孫,幾乎不可能竊佔土地,而招致祖先骨灰被地主驅趕的大不敬。況且,自己土地若遭占建墳,不會多年默不吭聲。呂在這塊土地上建祖父母墳墓已五十一年,林父及林的哥哥分別在四十年及卅年前去世時,呂的祖父母墳墓已建了超過十年,卻未見林父及林的哥哥提告異議;認定呂確實向林父購地,判林敗訴。

風水及命理大師指點迷津‧2015趨吉避凶

2014年大馬被形容為災難連連,禍不單行的一年,想必很多讀者皆想知道2015年又將會是怎樣的一個年份。且讓馬來西亞易經風水總會會長黃十林及知名命理顧問師李德榮,為讀者們一一道來2015年的運程走勢。

黃十林畢業於台灣政治大學經濟學士,曾擔任過連鎖店經理、金融界白領及開設餐館,但最終還是對自小就有濃厚興趣的風水學情有獨鍾,毅然在2002年開始全職擔任風水師,目前除了是十林風水命理學院院長外,也是富貴山莊首席風水顧問,以及多個神廟組織、協會及企業的風水顧問。
 
此外,素有“鐵拐李”之稱的李德榮則來自風水世家,從小耳濡目染下學習風水。雖然患有小兒麻痺症,但在不斷努力下開創了李德榮命理顧問有限公司(Grand Master LTE),擁有37年實戰經驗,現為多個發展商的風水顧問。
《星洲日報》記者專訪了2位風水及命理大師,從國運到大馬依斯干達特區走勢,為讀者們指點迷津。

問:2015年國家運程、經濟走向如何?

黃十林:投資方面需更小心
●黃十林(以下簡稱黃):國運與週期性有關,正所謂逢7必變,特別是在馬年和鼠年都會有很大的變化,並且牽連接下來幾年,可能是變得更好或變得更糟。比方說在1973年、1979年1990年石油大危機及2014年災禍連連,都是發生在鼠年或馬年。
雖然2008年大馬運勢一路大好,可是到了2014年大馬運勢開始走下坡至2017年,2017年之後國運才會慢慢好轉。
另,2015年因人為變化,包括落實消費稅、石油危機及馬幣疲軟,經濟悲觀下,民眾在投資方面需更加小心。銀行已經緊縮,相信房地產為了出售手上的單位,將會有一波促銷及割喉戰,各行各業都會受到衝擊,直到明年經濟才會開始回穩,2017年開始起步。

李德榮:今年到2017年經濟不好
●李德榮(以下簡稱李):國運每20年交接一次,交接也意味著萬物更新,2017年2月4日立春之後,國家經濟才開始好轉,因此在2015年到2017年之間,經濟都不是很好。
不過,在2015年下半年經濟會有短暫的復甦,各經濟領域要在8月7日後才會開始活躍,特別是以土及金為主的行業,即房地產及金融業。至於以木為主的家具業,則會過得比較艱難。
另外,不管是大馬或其他國家,可能會出現爭權奪利及相罵的情況,雖然在政治上這非常普遍,但這一年會特別顯著。另外,也會有高官因貪污而被揭發,並且會有火爆如示威等事情發生,今年太歲為木星,而木也代表女色,可能會有高官因色而身敗名裂。

問:大馬依斯干達特區接下來的走勢如何?

黃十林:依斯干達特區興旺30年
●黃:大馬依斯干達特區未來將會興旺30年,並成為東南亞數一數二的大城市,除了是因為地理位置關係,更重要的是其他國家經濟體不像該特區擁有大量的地庫,可以完完全全的打造一座新城市。不過,正如我說,大馬國運要到2017年之後才會好轉,同樣的該特區也會受到波及。
我不建議投資者購買公寓,因為公寓是過去10年來的最高峰,新山從來沒有這麼多的公寓單位,已經出現過剩的情況。如果是要買來自居的,不急於一時者可等個一、兩年,房價比較合理時才購買。
當然,危機也是轉機,在資源重新分配時,你是否能夠把握機會獲得更多資源,就必須看你本身的實力。接下來連鎖企業也會面對一波波的考驗,必須整頓內部,有實力者自然能生存下來,素質不佳的企業則會在這股洪流中被淘汰。

李德榮:多事之秋
●李:2017年2月4日到2044年2月4日,是大馬依斯干達特區興旺27年的期限,但在2015年該特區則是多事之秋,錢財虧損方面會非常清楚,特別是現在房產過剩,正所謂“孤陰不生,孤陽不長”。陽宅屬於陰;店面屬於陽,住宅與商業必須平衡,才能滋生萬物。
另外,如根據王者居住的地方為中心點,依斯干達特區正巧落在西與西南之間的交界線,屬於“騎線游魂卦”,也就是兩頭不到岸的意思。
不過,因該特區位處申卦位,即代表年長女性,如果是由較年長的女子來掌權,該特區將會風生水起。

問:大馬依斯干達特區房地產火熱,哪一區風水較好?哪一區又值得投資呢?

黃十林:老城區會有另一番作為
●黃:在風水學裡,水是非常重要的一環,河水疏通,生命才能啟動,絕對不能讓河水變成死水。比方說韓國十多年前清理了漢江,韓國的經濟就開始騰飛,現今柔州政府開始清理紗玉河,相信不久後老城區也會有另一番作為。
以風水學角度來說,大馬依斯干達特區中的A、B及D旗艦區風水都不錯,特別是在A區,雖然很多人認為A區已經飽和沒有地方可以發展,可是卻能夠進行“拉皮效果”,重新打造舊城區。

李德榮:依山傍水就是好的風水位
●李:所謂“入山尋水口,登穴看名堂”,龍一遇水就會停止,因此好的風水地必須有水有山,依山傍水符合風水天心十道條件,自然就是好的風水位。
根據推算,如以王者位為中心,2015年至2017年之間,風水位在西北方、西方、東北及南方位;2017年到2044年風水位則會在北方、西南、東南及東方位。

問:2015年有甚麼要提醒讀者注意的嗎?

黃十林:可來個心靈之旅
●黃:2014年是木馬年或金馬年,而大馬五行屬火,在加上位處赤道,太過燥熱,因此發生了很多重大事故,是充滿了恐慌、急躁及憂鬱的一年。而2015年則與去年一樣,屬於木羊年或金羊年,會延續去年的情緒及變動,不過會較去年來得好。
在這樣的一個年份,民眾可從宗教信仰、多與家人或老朋友在一起,紓緩負面的情緒,如果可以來個心靈之旅更佳。
雖然今年普遍的幸運色為藍色及黑色,但卻不是每一個場合及人人適合,如果違反了自然習俗,就違背了風水的原理。

李德榮:今年不宜接財神
●李:2015年屬於三碧星祿存星飛入中宮,五行中屬木,是一個爭吵、賊星及阿窿星的一年。做生意的朋友,要注意是否會有監守自盜,或窩裡反的事情發生;而有家庭的朋友,則需注意自己的家庭成員,不要讓他們去借阿窿,不然家庭成員會為此而爭吵不休。
在2015年2月4日立春時,五黃大病星飛入西方,而農曆正月初一財神位也在西方,如果讀者接財神不到,卻可能接到五黃大病星,所以今年是不宜接財神的一年。
至於今年的幸運色則是白色、金色、銀色、黃色及橙色為主。另外,讀者也必須注意地震及土崩,海陸空方面也是多事之秋,以及多注意血糖過高、心臟病及皮膚病等。

A Chinese astrologist tells us how to prosper this year — and the risks to avoid.

The Chinese Near Year begins Feb. 19, and American businesses hoping to reach more customers (Asian and non-Asian alike) are planning to mark the holiday with promotions designed to bring in the money.Traditionally, gifts of red envelopes filled with cash are given to loved ones on the holiday for good luck. In the Chinese zodiac, each Lunar New Year, which is celebrated by many Asian cultures, is associated with one of 12 animal signs. This is the Year of the Sheep (also referred to as the Year of the Ram or Goat).

To mark the occasion, Panda Express, the nation’s largest Chinese restaurant group, is giving out red envelopes to customers stuffed with coupons for either a free soda or a free order of Firecracker Chicken Breast. Peggy Cherng, co-founder and co-CEO of Panda, will also be passing out red envelopes filled with a fresh $1 bill to every employee at its Rosemead, Calif., corporate headquarters.Godiva is selling limited edition Year of the Goat gift boxes, with sweets that combine its traditional Belgian chocolate with edible flowers and exotic root flavors. Chase Bank is giving out traditional Chinese calendars and red envelopes to customers who want to give out their own gifts of money.


So what kind of economic year can we expect?

Doris Ingber, an expert in feng shui and 4 Pillars Analysis (a branch of Chinese astrology), says 2015 will be a year dominated by the economy.“We are at a turning point in the 12-year cycle,” says Ingber, who has offices in New York and Norwalk, Conn. “

The energy of wood, which represents the economy, is beginning to flower. Unemployment is down, wages are moving up, and costs have stabilized or lowered.”

Ingber says she’s often called in by businesses for staffing issues, and after the fact, when a company’s strategy isn’t working.“In China, they look at feng shui and astrology first, before putting together teams of people and designing spaces,” Ingber says. “

There’s still a bit of woowoo-ness to this in the United States, so many companies still don’t talk about using it.”Ingber says she left a career in fashion merchandising in 1999.

“I took the sales figures, looked at what went on in the past, and looked at what was coming in the next cycle,” she says.

“Now, I’m dealing with the science of intuition, and use software programs for feng shui and Chinese astrology to analyze information.”

Ingber, whose clients include investment advisers, designers who work with commercial and residential properties, healthcare providers and others, says portfolios should remain diversified to produce steady growth. “Be cautious,” she says.

“This is not a year for risk.”She explains that five elements (Wood, Earth, Fire, Metal and Water) affect everyone, and that the energy of each element can relate to industries.

The Chinese astrology expert says Wood industries should do well this year, as the element — which represents growth and change — dominates 2015. That makes this the Year of the Wood Sheep.

Wood industries include architecture, manufacturing with natural products, fashion, food, publications like newspapers, magazines and books, and education.

“Those who listen and communicate with their customers will thrive,” Ingber says.

Earth industries will be stable, consistent performers, including businesses that deal with real estate, building, gas/oil, mining, insurance, accounting, law and human resources.

Fire industries, she notes, are a safe bet, and include electricity/power companies, restaurants, the performing arts, entertainment, military and defense companies.

Metal industries are weak, including banking, technology (hardware), automobile manufacturing, engineering, and entrepreneurs or CEOs. “Companies and their leaders need to be more nimble, quick and flexible this year,” Ingber says. “This year’s energy supports those who are humanitarian and lead from a team-building orientation.”

Lastly, water industries are weak now, but are good investments for the future, she says. Service providers, transportation, tourism, and health care practitioners will not have a great year, but if businesses act with long-term gains in mind, they will show great strength in 2019, the Year of the Pig.

Clashing elements this year, Ingber notes, indicate more national and global discord, but conflicts will be less violent than in 2014. Dry, hot areas of the world and summer months will see flare-ups, but Ingber is optimistic that treaties and mergers will come out of the conflicts.

Politics will take center stage, affecting the economy and vice versa. The key to settling conflicts include bi-partisan alliances, global cooperation, and team-building in the workplace.

The stock market will perform similarly to last year, she adds.

While some industries may be predisposed to do better than others this year, everything depends on the individuals in the teams that leaders choose, she adds.“I’d want people in sales and marketing to have fire in their chart,” she says. “A CEO will need to have metal. The designer should have wood. In a year that’s all about money, the opportunity for prosperity is there for everyone, if we take advantage of it.”


Meanwhile, here are Ingber’s tips for creating prosperity in this Year of the Wood Sheep:

* Avoid direct confrontations… compromise and negotiation will achieve more than conflict;

* Home, food, clothing and comfort are a priority… surround yourself with beautiful, quality things, or make sure that what you produce is done with quality materials;

* Create powerful allies and strong connections;

* Master the soft sell technique;

* Be responsible in your decision-making… be the shepherd; and* Focus on charity and humanitarian acts… the sheep will reward you.

Mark Rylance will appear on Desert Island Discs on Radio 4 later today He said he makes major decisions in life based on the roll of a dice He also uses ancient Chinese divination techniques to make career choices. Rylance will also reveal that he was unable to speak until he was aged six.

In Wolf Hall he plays the supreme man of reason, Thomas Cromwell. But today actor Mark Rylance reveals that he has a far more superstitious side offscreen.The star confesses that he turned to the roll of the dice and an ancient Chinese divination technique to make decisions over his career – and credits the advice it gave for his 22-year marriage.In an interview with Desert Island Discs on Radio 4, Rylance says he ‘asked’ the 3,000-year-old ‘I Ching’ book for guidance in 1987 when he couldn’t choose between a career at the National Theatre and a part in Steven Spielberg’s film Empire Of The Sun.

He said: ‘I turned to the I Ching and you just ask it “Where now?”‘And it gives an answer. The answer it gave if I went to the theatre was community and that swayed it for me. I had never experienced community on film sets... And it was because of that decision I met my wife Claire.’ She was musical director at the theatre at the time.

Believers in I Ching – or ‘Book of Changes’ – solve problems in their lives by putting the result of dice throws into a hexagram, which can be looked up in the ancient text for meaning.In the interview, which airs at 11.15am today, Rylance talks candidly about his belief in fate, saying: ‘I think there is evidence for consciousness that is not limited by our physical nature.’Rylance, who could not speak properly until he was six, was the first artistic director of Shakespeare’s Globe Theatre.

Everything in the universe pulsates and vibrates. It is also said that everything in the universe has life in it, so does every piece of land and building. However, when the building design and dimensions adapted are in accordance to specific geometry, they pulsate and vibrate at their peak energy levels.  Hence dimension, size and geometry play a vital role in ensuring that the property exudes good energy.When the quality of energy and soil on which the property exists is good, it contributes to the harmony, wealth, health and happiness of the occupants.

The science of feng shui and vaastu takes into account the energies radiating from the four compass directions—north, east, south and west—and it explains in a simple way the selection of site, construction and design of a residence, condominiums, business premises and placement of rooms and décor in the building.Sick building syndrome is a popular terminology in the science of bau biology and bio-energetics.

The intrinsic quality of the energy of the soil, building and surroundings also influences the physical quality of the building. At times buildings fail structurally  due to faulty soil or foundation, but most often from the energies perspective, a building fails due to absence of positive flow and imbalance of energy levels. From the structural failure point of view, it is required to  investigate the quality of soil and then decide on the foundation of the building which forms an essential part of land analysis.

A building’s size, height and number of floors are largely influenced by the foundation on which it stands. The foundation is more than just a combination of bricks and mortar. It transmits the load of the super structure to the ground below, distributes the load uniformly to prevent unequal settlement, and prevents lateral movement. It also ensures a secure footing for the building and a firm bed over a large bearing area in the plot. The soil at the site should have a good load-bearing capacity to ensure that the building stands without displacements or sinking.

Both in vaastu and feng shui, a cracked, sunk or displaced building is considered bad and unsafe.When we analyse the geographical and geological  aspects of a property, the ancient texts from vaastu and feng shui gave a lot of importance to the study of the topography of the land, surroundings and cosmology of the universe with its array of stars, planets, continents, rivers, seas, mountains etc. The geological aspect of soil testing and inspection to ascertain the touch, smell, taste, habitation on the plot and colour are quintessential to ensure a good property.Walk on the piece of property you wish to invest, get the feel. Are you happy, exhausted or feeling sick while walking? The feeling gives a clue to the quality of the energy existing there. Check for the colour of the soil—is it dry, parched or marshy? Also see if the  land looks fertile; do you see any plants, grass or flowers blooming, or is the land termite infested?

The basic observation and the feel experienced on the land gives a clear insight on its quality and this would give ample information in designing the right dimension, orientation and room allocation on it.
